How This Calculator Works

We use the multiplier method — the same approach insurance adjusters and plaintiff attorneys use in real settlement negotiations. Here's the formula:

Settlement = (Economic Damages + (Pain & Suffering Multiplier × Medical Costs)) × State Multiplier × (1 - Fault %)

Why Multipliers Range 1.5× to 5×

Minor injuries (soft tissue, full recovery) typically settle at 1.5×–2× medical bills for pain and suffering. Catastrophic injuries (traumatic brain injury, paralysis, amputation, wrongful death) routinely settle at 4×–5× because of permanent life impact and future care needs. Our default (2.5× for moderate) reflects the median across reported personal injury verdicts.

State Multipliers — Why They Matter

Jury verdicts and insurance company behavior vary significantly by state. California and New York courts award notably higher non-economic damages on average; Alabama and Mississippi tend to award less. Our state factors (0.75×–1.4×) are illustrative estimates informed by publicly reported verdict patterns.
